Consultation Service Terms & Conditions of Use
THAT TRAVELISTA CONSULTATION SERVICE LIABILITY WAIVER AND CONSENT AGREEMENT
Effective Date: May 30, 2025
This Liability Waiver and Consent Agreement (“Agreement”) is entered into between you (“Client”) and That Travelista, in connection with your use of That Travelista’s consultation services (the “Services”).
By scheduling and participating in a consultation with That Travelista, you acknowledge and agree to the following terms:
1. Advisory-Only Services
- That Travelista provides general, personal, and experience-based advice on topics such as travel planning, living abroad, and career transitions.
- That Travelista does not provide legal, immigration, tax, employment, mental health, or financial advice, and nothing shared during a consultation should be construed as such.
- Clients are solely responsible for conducting their own due diligence and consulting with licensed professionals (e.g., attorneys, tax advisors, immigration specialists, career counselors) as needed.
- That Travelista does not book travel on behalf of clients, and all travel arrangements are the sole responsibility of the Client.
2. Scope of Topics
- Consultations may include, but are not limited to:
- Travel planning and destination research
- Moving abroad (including lifestyle logistics)
- Career changes, sabbaticals, or extended travel
- That Travelista does not represent or claim expertise in international law, immigration processes, tax regulations, employment law, or psychological counseling.
- Any insights or suggestions are based on personal opinion and life experience, not professional credentials or training.
- Romantic, sexual, or inappropriate comments or actions are not permitted during consultations. That Travelista reserves the right to end consultations at any time after the first romantic, sexual, or inappropriate interference.
3. Assumption of Risk
- Travel inherently involves risks, including but not limited to illness, injury, delay, financial loss, closures, or other unforeseen circumstances.
- You understand that decisions regarding travel, relocation, immigration, taxation, or employment carry inherent risks and may result in financial loss, legal consequences, or personal hardship.
- You voluntarily assume all such risks and understand that you are solely responsible for the outcomes of your decisions.
- That Travelista does not guarantee the accuracy, safety, legality, or reliability of any third-party services, destinations, or activities referenced during consultations.
- By using That Travelista’s Services, you understand and voluntarily accept all risks associated with travel, travel planning, and any topics discussed while using That Travelista’s Services.
4. Limitation of Liability
- By using the Services, you agree that That Travelista and its owner, Em, shall not be liable for any direct, indirect, incidental, special, or consequential damages, injuries, losses, or outcomes arising from your use of the Services, including but not limited to decisions related to and reliance on any advice given on:
- Travel and itinerary planning
- Visas, immigration status, or relocation
- Taxes or financial matters
- Employment or career transitions
- That Travelista makes no guarantees, warranties, or representations, express or implied, regarding the accuracy, legality, or fitness for a particular purpose of any information provided.
5. Third-Party Tools and Platforms
- That Travelista uses third-party platforms to facilitate Services, including:
- Calendly (appointment scheduling)
- Stripe (payment processing)
- Google Meet (video conferencing)
- Mailchimp and/or Flodesk (email communication)
- That Travelista is not responsible for the performance, privacy, terms, or data handling of these third-party platforms and cannot guarantee availability or security on their behalf.
- By using the Services, you consent to your information being shared with and processed through these platforms to facilitate your booking, payment, communication, and consultation.
6. Pricing and Payment Terms
- All prices listed on the That Travelista website are in United States Dollars (USD). That Travelista has no control over the prevailing foreign exchange rates or currency conversion fees that may be applied by Calendly, Stripe, or the Client’s financial institution.
- Prices listed are subject to change at any time without prior notice. However, once a booking is confirmed and payment is received, the Client will not be charged any additional amount in the event of a price increase, nor will any refund be issued in the event of a price decrease.
- Full payment is due at the time of booking. The Client’s preferred date and time for delivery of the Service will not be confirmed or reserved until full payment is successfully processed.
7. Data Collection and Privacy
- That Travelista collects basic personal information (responses to optional pre-call questionnaire) for the purpose of delivering Services.
- Payment information is processed by Stripe. That Travelista does not access or store your credit card details.
- Confirmation emails and communication may be sent via Mailchimp and/or Flodesk.
- That Travelista takes reasonable measures to protect your data but cannot guarantee the security of third-party platforms.
8. Refunds, Reschedules, and Missed Appointments
- All bookings are final and non-refundable. No guarantees are made regarding the usefulness, accuracy, or results of the Services.
- Clients are permitted one reschedule per consultation, provided That Travelista is notified at least 15 minutes before the original call start time. If a second reschedule is requested for the same consultation, the call will be canceled. In such cases, the client may submit five questions in a single email within seven (7) days of the canceled call date, to which That Travelista will respond. No further follow-up or correspondence is included.
- A no-show is defined as a failure to join the call without rescheduling at least 15 minutes prior to the scheduled start time. No-shows are not entitled to a reschedule or to the five-question email correspondence offered to those who reschedule.
- If a client arrives late to a consultation, the call will proceed for the remainder of the scheduled time only. The call will not be extended, and late arrivals are not entitled to the five-question email correspondence offered to those who reschedule.
If That Travelista must cancel a scheduled consultation, the Client will be entitled to a full refund. If That Travelista requests to reschedule a consultation, the Client will be offered the option to either:
- Reschedule at a mutually agreeable time, or
- Receive a full refund.
Refunds will be issued via the original payment method and in United States Dollars (USD). That Travelista is not responsible for any fluctuations in foreign exchange rates or currency conversion fees that may be applied by Calendly, Stripe, or the Client’s financial institution between the time of the original payment and the issuance of the refund.
9. Indemnification
You agree to indemnify and hold harmless That Travelista and its owner, Em, from any claims, damages, liabilities, or expenses arising out of or related to your use of the Services, including but not limited to travel decisions and arrangements, relocation efforts, immigration status, tax filings, employment decisions, or any reliance on advice provided.
10. Feedback and Testimonials
That Travelista may invite clients to provide feedback, testimonials, or reviews regarding the Services. By submitting any such content, you grant That Travelista an irrevocable, perpetual, non-exclusive, worldwide, and royalty-free license to use, reproduce, adapt, modify, publish, translate, and communicate this content in any medium or format, for promotional, marketing, or informational purposes.
You acknowledge that this license includes the right for That Travelista to edit or adapt your submission for clarity or brevity, provided that the core message is not misrepresented. You also agree that That Travelista is under no obligation to use any submitted feedback or testimonial.
11. Entire Agreement
This document represents the entire Agreement between the Client and That Travelista and supersedes any prior communications or understandings.
By scheduling and participating in a consultation with That Travelista, you confirm that you have read, understood, and agreed to this Liability Waiver and Consent Agreement.
